1. Comprehensive Service Description and Platform Capabilities

Andeshire provides a state-of-the-art, comprehensive AI-powered ATS platform that encompasses a full spectrum of recruitment and talent management solutions. Our service portfolio includes, but is not limited to, the following advanced capabilities:

  • Advanced resume screening and automated candidate evaluation using machine learning algorithms
  • Intelligent candidate matching and sophisticated ranking systems based on job requirements
  • Predictive analytics for candidate success probability and cultural fit assessment
  • Natural language processing for resume parsing and keyword extraction

You bear complete responsibility for maintaining the absolute confidentiality and security of your account credentials, including usernames, passwords, and any multi-factor authentication mechanisms. You are fully accountable for all activities, transactions, and communications that occur under your account, regardless of whether such activities were authorized by you.

You must immediately notify our security team of any suspected unauthorized access, security breaches, or suspicious activities related to your account. Failure to promptly report security incidents may result in account suspension and potential legal liability for resulting damages.

Account sharing is strictly prohibited. Each user must maintain individual accounts and must not share login credentials with colleagues, team members, or third parties under any circumstances.

Automatic Data Collection Notice for All Applicants:

When you submit an application for any position through the Andeshire platform, our system automatically collects, processes, and stores comprehensive application data as part of our standard recruitment workflow. This automated collection occurs regardless of whether you create a formal user account and is essential for the proper functioning of our AI-powered recruitment services.

The collected information includes, but is not limited to: complete resume documents, cover letters, contact information (email addresses, phone numbers, physical addresses), educational background, work history, references, portfolio materials, assessment results, interview recordings or notes, and any additional information voluntarily provided during the application process.

Detailed Data Usage Policies and Restrictions

Permitted Data Usage:

  • Recruitment and hiring evaluation processes conducted by authorized hiring organizations
  • AI-powered candidate matching and ranking within the specific tenant organization
  • Communication between candidates and hiring teams regarding specific opportunities
  • Performance analytics related to recruitment effectiveness (in aggregated, anonymized form)
  • System improvement and AI model training (using anonymized data only)

Strictly Prohibited Data Usage:

  • Sale, rental, or commercial distribution of personal data to third parties
  • Use of personal data for advertising, marketing, or promotional purposes unrelated to recruitment
  • Cross-tenant data sharing without explicit consent
  • Use of personal data for credit checks, background investigations, or non-recruitment purposes

Data Access Controls and Tenant Restrictions

Your personal data is accessible exclusively to authorized personnel within the specific hiring organization (tenant) to which you have applied. Our multi-tenant architecture ensures complete data isolation, preventing unauthorized cross-organizational access to candidate information.

Each tenant organization maintains independent data controls and access permissions. Data access is limited to individuals with legitimate business needs related to the recruitment process for positions to which you have applied.

Prohibited Activities and Violations

The following activities are strictly prohibited and may result in immediate account suspension, termination, and potential legal action:

  • Attempting to reverse engineer, hack, or compromise platform security
  • Uploading malicious software, viruses, or harmful code
  • Creating false identities or impersonating other individuals or organizations
  • Engaging in discriminatory practices based on protected characteristics
  • Violating intellectual property rights or confidentiality agreements
  • Using automated tools to scrape data or create artificial interactions
  • Attempting to access data or accounts without proper authorization

5. Payment Terms and Commercial Arrangements

Andeshire operates on a customized commercial model where payment terms, pricing structures, and billing arrangements are individually negotiated and formally agreed upon with each corporate client and enterprise user.

User Content and Data Rights:

While you retain ownership of the content you submit to our platform (resumes, profiles, etc.), you grant Andeshire a limited license to process, analyze, and utilize this information solely for the purposes of providing our recruitment services and improving our AI systems.

8. Governing Law and Legal Framework

These Terms and Conditions, along with all related agreements, policies, and legal relationships between users and Andeshire, are governed by and construed in accordance with the laws of the Argentine Republic. This governing law applies regardless of where users are located or where they access our services.

Dispute Resolution and Jurisdiction:

Any disputes, claims, or controversies arising from or relating to these terms, the use of our services, or any related matters shall be subject to the exclusive jurisdiction of the competent courts of Argentina.

Users agree to submit to the personal jurisdiction of Argentine courts and waive any objections to jurisdiction or venue in these courts.

The artificial intelligence systems, machine learning algorithms, and automated decision-support tools integrated within the Andeshire platform are sophisticated probabilistic systems that generate predictions, recommendations, and assessments based on statistical patterns derived from training data and algorithmic modeling. These systems operate using complex mathematical models that analyze multiple variables and data points to produce outputs that are intended to assist in recruitment and talent evaluation processes.

Users acknowledge and understand that artificial intelligence technology, regardless of its sophistication or the extent of testing and validation it has undergone, cannot and does not guarantee perfect accuracy, complete reliability, or absolute precision in its outputs, recommendations, or assessments. The probabilistic nature of AI systems means that there is always an inherent degree of uncertainty and potential for variation in results, even when processing identical or similar inputs under comparable conditions.

While Andeshire has conducted extensive testing, validation, and optimization of its AI systems and continues to invest significant resources in improving system performance, accuracy, and reliability, we expressly disclaim any warranties or guarantees regarding the absolute accuracy of AI-generated evaluations, candidate rankings, matching algorithms, or predictive assessments. Our commitment extends to providing our best effort to ensure optimal system performance and to continuously enhance the quality and reliability of our AI-powered services through ongoing research, development, and system refinement.

Users are strongly advised to treat all AI-generated outputs as decision-support tools rather than definitive determinations. Human judgment, professional expertise, and comprehensive evaluation should always be applied when making hiring decisions or other significant determinations based on AI-generated recommendations. The responsibility for all final hiring decisions, candidate evaluations, and employment-related determinations rests solely with the hiring organization and its authorized representatives.

Organizations using Andeshire's services must ensure compliance with all applicable employment laws, anti-discrimination regulations, and fair hiring practices. AI recommendations should never be the sole basis for employment decisions, and appropriate human oversight and review processes must be maintained to ensure legal compliance and fairness in all recruitment activities.

Comprehensive Limitation of Liability and Risk Allocation

To the maximum extent permitted under applicable law, including but not limited to Argentine commercial law, consumer protection regulations, and international commercial standards, Andeshire, its parent company RH Vision, the broader RH Group organizational structure, and all associated subsidiaries, affiliates, officers, directors, employees, agents, contractors, and service providers (collectively referred to as "Andeshire Entities") shall not be held liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to the use of, inability to use, or performance of the Andeshire platform and associated services.

This limitation of liability specifically includes, but is not limited to, damages or losses resulting from: hiring decisions made in reliance upon AI-generated recommendations, assessments, or evaluations; inaccuracies, errors, or omissions in artificial intelligence outputs, candidate rankings, or matching algorithms; system downtime, technical interruptions, or service unavailability; data loss, corruption, or unauthorized access to information; business interruption or loss of business opportunities; reputational damage or loss of goodwill; third-party claims or legal actions related to hiring decisions; integration failures with existing systems or third-party applications; and any consequential effects of platform usage on organizational operations or individual career prospects.

In jurisdictions where complete limitation of liability is not legally permissible, the aggregate liability of all Andeshire Entities for all claims, damages, losses, and causes of action, whether in contract, tort, negligence, or otherwise, shall be limited to the total amount of fees actually paid by the affected party to Andeshire for services during the twelve (12) month period immediately preceding the event giving rise to the claim. This limitation applies regardless of the legal theory upon which the claim is based and regardless of whether Andeshire has been advised of the possibility of such damages.

Users acknowledge that the AI-powered nature of our services involves inherent risks and uncertainties that cannot be completely eliminated through technological means. By choosing to utilize Andeshire's services, users voluntarily assume these risks and agree to hold harmless all Andeshire Entities from any adverse consequences resulting from AI system limitations, technological constraints, or the probabilistic nature of machine learning algorithms. Users further acknowledge that they have the technical expertise and professional judgment necessary to appropriately interpret and apply AI-generated insights within their organizational context.

This limitation of liability is fundamental to the commercial viability of providing AI-powered recruitment services at accessible pricing levels and reflects the shared risk allocation between Andeshire and its users. The provisions of this section shall survive termination of any service agreements and shall continue to apply to any claims or disputes arising from prior use of Andeshire services.

Extended Data Retention and Processing Specifications

Andeshire maintains comprehensive data retention policies designed to balance operational requirements, legal obligations, and user privacy interests. Personal data submitted through our platform, including but not limited to application materials, profile information, communication records, and system-generated analytics, may be retained for extended periods to support ongoing recruitment processes, legal compliance requirements, system improvement initiatives, and business continuity needs.

Candidate and applicant data may be retained for periods extending beyond the immediate recruitment cycle to facilitate future opportunities, maintain talent pipeline databases, support reference checking processes, and enable longitudinal analysis of recruitment effectiveness. The specific retention periods vary based on data type, user preferences, organizational requirements, and applicable legal obligations, with some categories of information potentially being maintained for several years following initial submission.

Our AI systems continuously process and analyze aggregated, anonymized data derived from platform interactions to improve algorithm performance, enhance matching accuracy, identify bias patterns, and develop new features and capabilities. This processing occurs through automated systems and may involve complex statistical analysis, pattern recognition, and predictive modeling that generates insights used to benefit all platform users through improved service quality and enhanced recruitment outcomes.

International data transfers may occur as part of our global service delivery model, cloud infrastructure requirements, and business continuity arrangements. Such transfers are conducted in accordance with applicable data protection laws and international transfer mechanisms, including standard contractual clauses, adequacy decisions, and other legally recognized safeguards designed to protect personal information during cross-border processing activities.

Users acknowledge that complete data deletion may not be immediately feasible due to system architecture constraints, backup retention requirements, legal preservation obligations, and the distributed nature of modern cloud computing environments. Data deletion requests will be processed in accordance with our established procedures and applicable legal requirements, with reasonable efforts made to remove personal information from active systems within established timeframes while maintaining compliance with legal and regulatory obligations.

Force Majeure and Extraordinary Circumstances

Andeshire shall not be liable for any failure or delay in performance of its obligations under these terms when such failure or delay results from circumstances beyond its reasonable control, including but not limited to: natural disasters, acts of God, extreme weather events, earthquakes, floods, fires, or other environmental catastrophes; war, terrorism, civil unrest, political instability, or government actions; pandemic, epidemic, or public health emergencies; labor strikes, work stoppages, or labor disputes; cyber attacks, security breaches, or malicious activities targeting our infrastructure; failure of internet service providers, telecommunications networks, or essential utilities; regulatory changes or government mandates that impact service delivery; and other extraordinary circumstances that materially affect our ability to provide services.

During force majeure events, Andeshire will make reasonable efforts to minimize service disruptions, communicate with users regarding the status of services, implement alternative service delivery methods where feasible, and resume normal operations as quickly as circumstances permit. Users acknowledge that such events may result in temporary service limitations, data processing delays, or alternative service delivery arrangements, and agree that Andeshire shall not be held liable for any consequences resulting from such extraordinary circumstances.

Severability and Legal Construction Principles

If any provision of these Terms and Conditions is determined to be invalid, unenforceable, or contrary to applicable law by a court of competent jurisdiction, such determination shall not affect the validity or enforceability of the remaining provisions. The invalid or unenforceable provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent, or if such modification is not possible, the provision shall be deemed severed from these terms without affecting the remainder of the agreement.

These terms represent the complete understanding between the parties regarding the subject matter and supersede all prior negotiations, representations, or agreements relating to the use of Andeshire services. No modifications to these terms shall be effective unless made in writing and agreed to by authorized representatives of Andeshire. The failure to enforce any provision of these terms shall not constitute a waiver of that provision or any other provision.

Third-Party Integration and External Service Dependencies

The Andeshire platform may integrate with various third-party services, applications, and data sources to enhance functionality and provide comprehensive recruitment solutions. These integrations may include job boards, social media platforms, background check services, assessment tools, calendar systems, communication platforms, and other recruitment-related technologies. Users acknowledge that such third-party services operate under their own terms of service and privacy policies, which may differ from Andeshire's policies and over which Andeshire has no control.

Andeshire makes no warranties regarding the availability, functionality, accuracy, or reliability of third-party services and shall not be liable for any issues, damages, or consequences arising from the use of or reliance upon such external services. Changes to third-party service availability, functionality, or terms may impact Andeshire's service delivery capabilities, and users acknowledge that such changes are beyond Andeshire's control and may necessitate modifications to platform features or functionality.

Regulatory Compliance Framework and Industry Standards Adherence

Andeshire operates within a complex regulatory environment encompassing data protection laws, employment regulations, artificial intelligence governance frameworks, consumer protection standards, and industry-specific compliance requirements across multiple jurisdictions. While we maintain robust compliance programs and regularly update our practices to align with evolving regulatory requirements, users acknowledge that regulatory landscapes are subject to change and that compliance obligations may vary based on user location, industry sector, and specific use cases.

Users bear responsibility for ensuring that their use of Andeshire services complies with all applicable laws and regulations in their jurisdiction, including but not limited to employment law, anti-discrimination statutes, data protection regulations, and industry-specific compliance requirements. Andeshire provides general guidance and best practices but cannot provide legal advice or guarantee compliance with specific regulatory requirements that may apply to individual users or organizations.

Changes in applicable laws or regulations may require modifications to service features, data processing practices, or user obligations. Andeshire reserves the right to implement necessary changes to maintain legal compliance, even if such changes affect existing functionality or require user adaptations. Users will be notified of significant compliance-related changes through appropriate communication channels and provided with reasonable time to adjust their practices accordingly.
